Comparative Legal Analysis
Work Package 1 (WP1) provides an analysis of relevant Finnish, Norwegian and UK legislation, focusing on the powers of national authorities, the relevant safeguards for privacy and accountability mechanisms as expressed in current and proposed legislation relating to internet surveillance. These findings are further analysed in the context of human rights law, especially the European Convention on Human Rights, to consider how well the national legislation accounts for these legal instruments. On this basis, WP1 aims to establish, through an analysis of relevant legislation: (1) How traditional principles of jurisdiction limit the powers of states to conduct online surveillance; and (2) How human rights law, especially the European Convention on Human Rights, influences online surveillance.
